I don't think there is a draw. 

If the Germans don't meet the "immediate" VC, then the ONLY VC is defined as
an American action. So if the Germans don't get the immediate victory, and
the Americans don't meet the conditions for their VC - then the Germans win.


It would be easier to see with a flowchart. :)
