You could play it that way. Alternatively, if the player controlling the
moving unit neglects to ask about whether his moving unit actually gets WA
or not (i.e., he just *assumes* that he has it, without declaring it), you
could play it that the still-HIP unit has WA, but the moving player won't
know about it until the unit loses HIP and claims its WA at that time.
This latter method certainly requires a more "friendly" style of play, I
think. In any case, a wise and aggressive moving player could demand to
know whether he has WA in all cases as he moves, and whenever a situation
comes up as you describe above, the non-moving player would indeed be forced
to lose HIP, since he's not allowed to lose WA.
Note the last sentence of B9.324 -- a HIP unit may claim its WA "at any
time", it just can't remain HIP while it does so. I think an argument that
this overrides the B9.323 "as soon as possible" clause has merit.
