If the in-hex terrain has zero TEM then the rule is very clear. The HIP unit
is REQUIRED to claim the WA - and would do so at setup. 

The rule isn't crystal clear, but I would agree with you that the HIP unit
can claim WA as it is placed on board. This would happen before the moving
unit could claim it, I think.
