Of course, there is nothing that says a moderated list would have
to be 100% cleaned of anything slightly off-topic. In fact most actively
moderated lists/newsgroups I read only moderate out the spam on a day
to day basis, only hitting real posters when there is an extended bit of
off-topicness or to head off a flamewar.
Now, IME, the people who are the loudest against moderation,
(and most likely to use an excluded middle fallacy arguing against it),
are the same ones who tend to be the reason for moderation being
sometimes needed.
